Illegal Credit Card Contract Explained

Under very strict consumer credit laws loan merchants, credit card companies or companies who provide any form of credit have to abide by a certain code of practice, which is formed under the Consumer Credit Act 1974.

However, lots of these companies have not stuck by the letter of the law and 1,000's of credit agreements issued before April 2007 have lots of 'flaws' and as such the credit agreement can be proven to be invalid or 'unenforceable'. In certain situations this means you can clear credit card debt and even claim back any loan payments, including any interest you paid.

For example, unfair terms in your credit agreement could be:

  • it doesn't include the credit charges
  • the rate of interest and whether it will vary throughout the course of the agreement
  • it doesn't include your signature
  • it doesn't include a notice of cancellation (if it is a cancellable agreement)
  • no details of the repayment schedule
