Unenforceable Consumer Credit Agreements - Credit & Loan debts cleared

Unenforceable Consumer Credit Agreements Explained

Under very tight consumer credit laws loan companies, credit card companies or corporation who provide any form of credit have to adhere to very specific guidelines which is formed under the Consumer Credit Act 1974.

However, a lot of these organisations have not operated according to guidelines and 1,000's of credit agreements issued before April 2007 which have lots of missing terms and as such the loan agreement can be proven to be invalid. In some circumstances this means you can clear multiple credit card debts or single or multiple loan debts and even claim back any loan installments, plus the interest you paid.

For example, typical invalid terms in the consumer credit agreement could be:

  • it doesn't show the credit charges
  • the interest rate and whether it is likely to change during the agreement
  • it doesn't have your signature
  • it doesn't have a notice of cancellation (if it is a cancellable agreement)
  • no specific details of the repayment schedule
